Terms & Conditions

GENERAL TERMS AND CONDITIONS

1. SCOPE

1.1. The products offered in our online shop are intended exclusively for consumers whose place of residence and delivery address are in Switzerland or the Principality of Liechtenstein (hereinafter “customers”).

1.2. The operator of the online shop at www.peachperfect.ch (hereinafter “online shop”) and your contractual partner is:

core.iq GmbH
Gussstrasse 20
8180 Bülach, Switzerland

1.3. These General Terms and Conditions (GTC) apply to all contracts concluded between you as a customer and us as the operator of the online shop (hereinafter “seller”). By placing an order, you accept the GTC in the version valid at that time. Verbal or telephone agreements require written confirmation, which may also be given by email.

2. CONCLUSION OF CONTRACT

2.1. The offer to conclude a purchase contract is made by the customer by completing the order page in full and clicking the “Buy now” button. The customer remains bound by the order for one week. The contract is concluded if we accept the order within this period.

2.2. After submitting the order, the customer receives an order confirmation by email. This merely confirms that we have received the order and does not yet constitute acceptance of the contract.

2.3. The contract is only concluded when we accept the order, either by issuing an invoice, an order confirmation or a shipping confirmation, or at the latest by delivering the goods.

2.4. The contract only covers the items listed in our invoice, order confirmation or shipping confirmation, which also defines the scope of performance.

2.5. The contract is concluded in German. The data stored by us serves as proof of the conclusion of the contract.

2.6. The customer can print the order and the data entered during the ordering process. In addition, a customer account can be opened in which the order data can be viewed after logging in. The seller reserves the right to block customer accounts at its own discretion.

3. PRICES AND SHIPPING COSTS

3.1. All prices are stated in Swiss francs (CHF) and include statutory value added tax (VAT), advance recycling fees and copyright levies. Prices and product vintages are subject to change; the price at the time of ordering applies.

Prices may differ between products offered online and in stores, and for reduced or discounted items. There is no entitlement to subsequent price adjustments.

3.2. Shipping costs are:

  • For orders of CHF 70.- or more: free of charge.
  • For orders under CHF 70.-: CHF 6.90.

4. PAYMENT & RETENTION OF TITLE

4.1. Payment can be made by credit card (VISA, Mastercard, American Express), debit card, PostCard or invoice, provided these payment options are available in the online shop. Credit and debit card payments are transmitted in encrypted form.

4.2. The invoice amount is due immediately unless otherwise stated.

4.3. For purchases on invoice, we charge a fee of CHF 2.- to cover the cost of the credit check. The invoice amount is payable within 30 days of the invoice date. In the event of late payment, we charge default interest of 5 % per month on the outstanding amount as well as reminder fees:

  1. Reminder: CHF 10.00
  2. Reminder: CHF 10.00
  3. Reminder: CHF 25.00

4.4. core.iq GmbH grants third parties commissioned with checking the customer’s creditworthiness and collecting the purchase price (in particular the credit agency CRIF AG, Zurich, or an affiliated company) access at any time to the personal data arising from the business relationship. The customer may revoke this consent in writing at any time.

4.5. The customer is only entitled to rights of set-off or retention if the claim has been legally established or is undisputed. The customer’s rights in the event of defects in the delivery remain unaffected.

4.6. The goods remain the property of the seller until the invoice amount has been paid in full. The seller is entitled to make a corresponding entry in the register of retention of title.

4.7. Our online shop is designed for the needs of private customers. For this reason, it is not possible to issue invoices or VAT statements retrospectively.

5. DELIVERY & TRANSFER OF RISK

5.1. Delivery is made exclusively to Switzerland and the Principality of Liechtenstein. The goods are sent to the delivery address provided by the customer.

5.2. Delivery is subject to us being supplied correctly and on time by our suppliers. Force majeure such as strikes, natural disasters or supply shortages on the part of manufacturers or upstream suppliers does not constitute a delay in delivery. The seller is not liable for delivery delays caused by third parties.

5.3. Partial deliveries are permitted insofar as this is reasonable for the customer. If, after conclusion of the contract, it turns out that ordered goods cannot be delivered, the customer has the right to withdraw from the contract.

5.4. The risk of accidental deterioration or loss of the goods passes to the customer upon handover to the transport company.

5.5. The delivery times stated in the order confirmation or in the online shop are calculated from the shipping confirmation.

6. DUTY TO INSPECT AND NOTIFY, LIABILITY FOR DEFECTS

6.1. The customer is obliged to inspect the delivered goods immediately upon receipt. Defects or missing items must be reported to customer service (E-Mail) immediately, but no later than 7 days after delivery. If no timely notification is made, any claims for defects lapse.

6.2. Hidden defects must be reported to customer service immediately after discovery; otherwise the goods are deemed accepted with regard to these defects as well.

6.3. Defects are remedied by repair or replacement. The customer must return the defective product together with a copy of the invoice and a detailed description of the defect.

6.4. If the repair fails, the customer may withdraw from the contract. Any claim to a price reduction is excluded.

6.5. Normal wear and tear, improper handling and external influences are excluded from the warranty.

7. RIGHT OF EXCHANGE

7.1. The customer may exchange the goods within 30 days of the delivery date. The goods must be unused, in their original packaging and complete with all accessories.

7.2. Opened or sealed products as well as food and supplements are excluded from exchange.

7.3. The customer bears the cost of the return shipment.

8. LIABILITY

All claims of the customer are conclusively governed by these GTC. The seller is not liable for indirect or consequential damage that did not occur directly to the goods.

9. DATA PROTECTION

Personal data is collected and processed in accordance with our privacy policy. The seller uses customer data for direct marketing, including advertising by email and post.

10. SEVERABILITY CLAUSE & RESERVATION OF CHANGES

10.1. Should any provision of these GTC be invalid or unenforceable, the validity of the remaining provisions shall not be affected. The contracting parties undertake to replace the invalid provision with a valid provision that comes as close as possible to the intended economic purpose.

10.2. Amendments or additions to these GTC must be made in writing. This also applies to any amendment of the written form requirement. The customer agrees to the amended GTC as soon as they make use of a service of the seller after the amendment.

11. APPLICABLE LAW & PLACE OF JURISDICTION

11.1. Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the rules of conflict of laws.

11.2. The place of jurisdiction for all disputes arising from or in connection with these GTC is the seller’s registered office in Bülach, Switzerland. However, the seller is entitled to sue the customer at their place of residence.
